一、項(xiàng)目概況
Project Overview
前海位于廣東省深圳市西部，珠江口東岸，毗鄰香港，規(guī)劃為未來(lái)的粵港澳深度合作示范區(qū)和城市新中心。
Qianhai is located in the west of Shenzhen, Guangdong Province, on the east bank of the Pearl River Estuary, adjacent to Hong Kong. It is planned as a future Guangdong-Hong Kong-Macao in-depth cooperation demonstration zone and a new urban center.

本次招標(biāo)項(xiàng)目位于前海前灣片區(qū)，共包括三塊用地，分別是十單元01街坊的前海深港專業(yè)服務(wù)業(yè)小鎮(zhèn)（以下簡(jiǎn)稱“專業(yè)服務(wù)業(yè)小鎮(zhèn)”）、九單元06街坊的前海深港未來(lái)產(chǎn)業(yè)小鎮(zhèn)（以下簡(jiǎn)稱“未來(lái)產(chǎn)業(yè)小鎮(zhèn)”）及九單元04街坊的前海深港產(chǎn)學(xué)研創(chuàng)新小鎮(zhèn)（以下簡(jiǎn)稱“產(chǎn)學(xué)研創(chuàng)新小鎮(zhèn)”）。深港專業(yè)服務(wù)業(yè)小鎮(zhèn)位于聽(tīng)海大道與前灣三路的西側(cè)；深港未來(lái)產(chǎn)業(yè)小鎮(zhèn)位于前灣二路、前灣三路中間與聽(tīng)海大道相鄰；深港產(chǎn)學(xué)研創(chuàng)新小鎮(zhèn)位于前灣二路與夢(mèng)海大道的北側(cè)交匯處。
This bidding includes three projects: Qianhai SZ-HK Professional Service Town (“Professional Service Town” for short), Qianhai SZ-HK Future Industrial Town (“Future Industrial Town” for short) and Qianhai SZ-HK Industry-Academia-Research Innovation Town(“Industry-Academia-Research Innovation Town” for short). The Professional Service Town is located in block 01, Unit 10, on the west side of Tinghai Avenue and Qianwan 3rd Road. Future Industrial Town is located in block 06, Unit 9, between Qianwan 2nd Road and Qianwan 3rd Road, and adjacent to Tinghai Avenue. Industry-Academia-Research Innovation Town is located in block 04, Unit 9, at the intersection of Qianwan 2nd Road and Menghai Avenue on the north side.

深化深港合作，為香港服務(wù)業(yè)拓展空間，對(duì)接香港專業(yè)服務(wù)業(yè)優(yōu)勢(shì)資源及先進(jìn)經(jīng)驗(yàn)，重點(diǎn)發(fā)展法律、會(huì)計(jì)、文化創(chuàng)意、人力資源和工程服務(wù)等專業(yè)服務(wù)業(yè)，打造深港專業(yè)服務(wù)業(yè)產(chǎn)業(yè)及人才集聚區(qū)、深港專業(yè)服務(wù)業(yè)融合發(fā)展先導(dǎo)區(qū)、深港專業(yè)服務(wù)開(kāi)放示范區(qū)和港式專業(yè)服務(wù)體驗(yàn)區(qū)。
To deepen the cooperation between Shenzhen and Hong Kong; to expand the space for Hong Kong's service industry; to connect with the advantageous resources and advanced experience of Hong Kong's professional service industry; to focus on the development of professional service industries such as law, accounting, cultural creativity, human resources and engineering services; to create SZ-HK professional service industry and talent gathering area, SZ-HK professional service integration development pilot area, SZ-HK professional service opening demonstration area and HK-style specialty service experience area.
2.2前海深港未來(lái)產(chǎn)業(yè)小鎮(zhèn)
Qianhai SZ-HK Future Industrial Town
未來(lái)產(chǎn)業(yè)小鎮(zhèn)旨在打造成為深港未來(lái)產(chǎn)業(yè)發(fā)展聚集地，重點(diǎn)面向新一代信息技術(shù)、綠色低碳、高端裝備制造、生物醫(yī)藥、數(shù)字經(jīng)濟(jì)、新材料、海洋經(jīng)濟(jì)等戰(zhàn)略型新興產(chǎn)業(yè)和未來(lái)產(chǎn)業(yè)，為香港提供發(fā)展空間，拓展產(chǎn)業(yè)發(fā)展方向。
The project aims to become a gathering place for SZ-HK's future industrial development, focusing on strategic emerging industries and future industries such as new generation of information technology, green and low-carbon, high-end equipment manufacturing, bio-medicine, digital economy, new materials and Marine economy, so as to provide space for Hong Kong's development and expand its industrial development direction.
2.3前海深港產(chǎn)學(xué)研創(chuàng)新小鎮(zhèn)
Qianhai SZ-HK Industry-Academia-Research Innovation Town
以深港產(chǎn)學(xué)研融合創(chuàng)新為總體目標(biāo)，將打造集科學(xué)發(fā)現(xiàn)、技術(shù)發(fā)明、產(chǎn)業(yè)發(fā)展為一體的深港產(chǎn)學(xué)研創(chuàng)新小鎮(zhèn)，構(gòu)建政產(chǎn)學(xué)研資介用等要素深度融合的創(chuàng)新生態(tài)系統(tǒng)，為香港提供發(fā)展空間，注入發(fā)展動(dòng)能。
With the overall goal of integrating and innovating SZ-HK industry-academia-research, we will build an innovative town integrating scientific discovery, technological invention and industrial development, and build an innovation ecosystem with in-depth integration of government-enterprises-academia-research funds, media and other factors, so as to provide development space and inject development momentum for Hong Kong.
三、招標(biāo)范圍
Bidding Content
本項(xiàng)目包含三塊用地，其中前海深港產(chǎn)學(xué)研創(chuàng)新小鎮(zhèn)用地面積為3.89萬(wàn)m2，總建筑面積為7.47萬(wàn)m2，容積率為1.5；前海深港未來(lái)產(chǎn)業(yè)小鎮(zhèn)用地面積為7.91萬(wàn)m2，總建筑面積為14.21萬(wàn)m2，容積率為1.5；前海深港專業(yè)服務(wù)業(yè)小鎮(zhèn)用地面積為6.63萬(wàn)m2，總建筑面積為12.73萬(wàn)m2，容積率為1.5。
This project includes three lands, Qianhai SZ-HK Industry-Academia-Research Innovation Town covers a land area of 38,900m2, a gross floor area of 74,700m2, and FAR of 1.5; Qianhai SZ-HK Future Industrial Town covers a land area of 79,100m2, a gross floor area of 142,100m2, and FAR of 1.5; Qianhai SZ-HK Professional Service Town covers a land area of 66,300m2, a gross floor area of 127,300m2 and FAR of 1.5.
項(xiàng)目中標(biāo)后的設(shè)計(jì)工作具體范圍、深度及服務(wù)內(nèi)容主要包括但不限于以下內(nèi)容：完成建筑方案設(shè)計(jì)，景觀方案設(shè)計(jì)，室內(nèi)方案設(shè)計(jì)等（詳見(jiàn)《設(shè)計(jì)任務(wù)書(shū)》）
The specific design scope, depth and service contents after winning the bid mainly include but are not limited to: architectural scheme design, landscape scheme design and interior scheme design, etc. (See the Design Brief for details)
本次招標(biāo)工作分三個(gè)階段進(jìn)行，第一階段資格預(yù)審階段；第二階段方案投標(biāo)階段；第三階段定標(biāo)階段。各階段主要設(shè)計(jì)工作內(nèi)容包括：
This bidding will be undertaken by 3 stages: Stage 1-Pre-qualification, Stage 2-Scheme Bidding, Stage 3-Deciding the Winning Bidder. The main design content of each stage:
3.1第一階段-資格預(yù)審階段
Stage 1 –pre-qualification
1) 申請(qǐng)報(bào)名文件（詳見(jiàn)《招標(biāo)文件（工作規(guī)則）》）：
Application documents (See the Bidding Documents (Working Rules) for details)
2) 概念提案。設(shè)計(jì)單位統(tǒng)一就未來(lái)產(chǎn)業(yè)小鎮(zhèn)進(jìn)行設(shè)計(jì)，提交2頁(yè)A3成果：含總平面圖及能表達(dá)設(shè)計(jì)意圖的效果圖（形式不限）。
Concept proposal. The bidders design the Future Industrial Town, and submit 2 pages of A3: including the master plan and renderings that can express the design intention (the form is not limited).
3) 投標(biāo)人認(rèn)為有必要提供的其它材料。
Other materials considered necessary by the bidder.
4) 資格預(yù)審報(bào)名文件提交形式（詳見(jiàn)《招標(biāo)文件（工作規(guī)則）》）：
Document sealing requirements (See the Bidding Documents (Working Rules) for details):
紙質(zhì)文件：所有紙質(zhì)文件提供1套正本及4套副本，其中正本須加蓋公章或掃描打印電子章；提交的文件應(yīng)遵循環(huán)保原則，雙面打印，避免過(guò)度包裝。1份正本和4份副本先分別密封在兩個(gè)密封袋內(nèi)，再統(tǒng)一密封包裝在一個(gè)外密封袋中，并在外密封袋上注明“投標(biāo)文件（申請(qǐng)報(bào)名文件或概念提案文件）”、項(xiàng)目名稱、投標(biāo)人名稱。
Paper documents: 1 original and 4 copies shall be provided for all paper documents, of which the original shall be stamped with official seal or scanned and printed electronic seal; the submitted documents shall follow the principle of environmental protection and be printed on both sides to avoid excessive packaging. One original and four copies shall be sealed in two sealed bags respectively, and then sealed and packed in one outer sealing bag. The outer sealing bag shall be marked with " bidding document (application document or concept proposal document)", project name and name of the bidder.
申請(qǐng)報(bào)名文件按順序裝訂成一冊(cè)，并列目錄。A4尺寸，用軟皮質(zhì)膠裝。正本封面及扉頁(yè)須加蓋公章或掃描打印電子章，含封面封底和扉頁(yè)不超過(guò)40頁(yè)（正反面為1頁(yè)）。
The application documents shall be bound into one volume in order and listed in the table of contents. A4 size in soft leather. The front cover and front page of the original shall be stamped with official seal or scanned and printed electronic seal, including the back cover and the front page of which shall not exceed 40 pages (1 page for the front and back).
概念提案為2頁(yè)A3尺寸（不含封面封底），簡(jiǎn)裝橫版文本，正本封面或扉頁(yè)需加蓋公章或掃描打印電子章。
The concept proposal document is a 2-page A3 size (excluding the cover and back cover), and it is simple and horizontal version text. The cover or title page of the original should be stamped with official seal or scanned electronic seal.
電子文件：以上文件的電子文檔（可編輯版本）拷貝到U盤(pán)（2個(gè)），與文本一并提交；電子材料分為兩個(gè)部分，概念提案為單獨(dú)一個(gè)文件，其余內(nèi)容為一個(gè)文件或文件夾。密封包裝在1個(gè)密封袋中，在密封袋上注明“電子文件”、項(xiàng)目名稱、投標(biāo)人名稱。
Electronic documents: the electronic documents (editable versions) of the above documents are copied to USB flash disk (2 copies) and submitted together with the text; the electronic materials are divided into two parts, the concept proposal is a single document, and the rest contents are a document or folder. The sealed package shall be packed in a sealed bag, and the sealed bag shall be marked with "electronic document", project name and the name of the bidder.
所有資格預(yù)審報(bào)名文件須在2020年12月28日17：00前送至或郵至招標(biāo)單位指定地點(diǎn)(地點(diǎn)：深圳市福田區(qū)石廈街新天世紀(jì)商務(wù)中心B座12樓層1212號(hào)日杰瑞欣辦公室)。
All pre-qualification application documents must delivered or mailed to the location before 17:00, December 28, 2020. (Address: No. 1212, 12F, block B, Xintian Century Business Center, Shixia street, Futian District, Shenzhen).
3.2第二階段-方案投標(biāo)階段，提交的最終成果應(yīng)包括完整、清晰的設(shè)計(jì)說(shuō)明與圖紙。設(shè)計(jì)說(shuō)明應(yīng)包含建筑、結(jié)構(gòu)、機(jī)電等各專業(yè)詳細(xì)說(shuō)明，整體設(shè)計(jì)理念、模塊化設(shè)計(jì)理念及經(jīng)濟(jì)指標(biāo)等，設(shè)計(jì)圖紙應(yīng)包括但不限于總平面圖、效果圖、技術(shù)圖紙及分析圖等。投標(biāo)人對(duì)3小鎮(zhèn)均需提交概念方案，并結(jié)合方案特點(diǎn)選擇不少于1個(gè)小鎮(zhèn)進(jìn)行重點(diǎn)表達(dá)。（詳見(jiàn)《設(shè)計(jì)任務(wù)書(shū)》）。
Stage2-Scheme Bidding .The final submissions submitted during the bidding phase should include complete and clear design description and drawings. The design description should include detailed descriptions of architecture, structure, electromechanical and other majors, overall design concepts, modular design concepts and economic indicators, etc. The design drawings should include, but are not limited to, general layout, renderings, technical drawings and analysis drawings. Bidders need to submit conceptual design for 3 Towns,and combined with the characteristics of the design select no less than 1 Town for key expressions. (See the Design Brief for details)
3.3第三階段-定標(biāo)階段（詳見(jiàn)《設(shè)計(jì)任務(wù)書(shū)》）。

四、招標(biāo)規(guī)則概要
Overview of bidding rules
4.1第一階段-報(bào)名及資格預(yù)審階段
Stage 1 – Registration and Prequalification
1)投標(biāo)方式及報(bào)名條件
Registration
本次招標(biāo)采用公開(kāi)報(bào)名的方式，設(shè)計(jì)機(jī)構(gòu)須是中華人民共和國(guó)境內(nèi)、外注冊(cè)的企業(yè)，允許組建聯(lián)合體參加，聯(lián)合體成員單位家數(shù)不超過(guò)2家，聯(lián)合體成員不得再單獨(dú)參加，或者與多家設(shè)計(jì)機(jī)構(gòu)組成聯(lián)合體參加。不接受個(gè)人報(bào)名。
The bidding is open for registration. Design team must be a company registered either in the P.R. China or other countries. Registration in the form of design consortium is acceptable. Each consortium shall have no more than two members, who shall not participate alone again or form a consortium with other design teams. One person registration is not accepted.
2)資格預(yù)審
Prequalification
使用記名投票的方法，選出9家入圍的設(shè)計(jì)機(jī)構(gòu)，參加第二階段的方案投標(biāo)工作。同時(shí)再評(píng)選出2家備選設(shè)計(jì)機(jī)構(gòu)(須排序)，如有入圍的投標(biāo)人退出，則備選設(shè)計(jì)機(jī)構(gòu)依序替補(bǔ)。
Select 9 name listed bidders by open ballot to next stage. And 2 alternatives in order who will enter the competition by order if any of the 9 bidders quit.
3)9家入圍投標(biāo)人應(yīng)按時(shí)提交《投標(biāo)確認(rèn)函》�！锻稑�(biāo)確認(rèn)函》須投標(biāo)人簽字蓋章，如投標(biāo)人為聯(lián)合體，則聯(lián)合體各方均須簽字蓋章�！锻稑�(biāo)確認(rèn)函》遞交時(shí)間為2020年12月31日。如因疫情等原因在2020年12月31日無(wú)法提交鮮章原件的投標(biāo)人，可以先提交掃描打印文件，并且在2021年1月13日17：00之前遞交《投標(biāo)確認(rèn)函》的鮮章原件，掃描打印文件與鮮章原件缺一不可。
The 9 name listed bidders should submit the Bid Confirmation Letter on time.( refer to annex 3 for the format), that must be signed and sealed by the bidder. If the bidder is a consortium, all parties of the consortium must sign and seal. And the Bid Confirmation Letter is submitted on December 31, 2020. If the original fresh seal cannot be submitted this time due to epidemic or other reasons, the scanned document can be submitted first, and the original fresh seal of the Bid Confirmation Letter must be submitted before 17:00 on January 13, 2021.
若遞交《投標(biāo)確認(rèn)函》的投標(biāo)人因非不可抗力因素中途退出或最終放棄參與，招標(biāo)人有權(quán)在今后拒絕該設(shè)計(jì)機(jī)構(gòu)參加招標(biāo)人的任何項(xiàng)目。
After submitting the Bid Confirmation Letter, if any bidder has withdrawn eventually due to non-force majeure, the tenderee have the right to refuse their participation in any other project of the tenderee in the future.
4.2 第二階段-方案投標(biāo)階段
Stage2-Scheme Bidding
通過(guò)資格預(yù)審入圍的9名設(shè)計(jì)單位向評(píng)標(biāo)委員會(huì)進(jìn)行述標(biāo)答辯。
本輪投標(biāo)采用明標(biāo)的方式進(jìn)行評(píng)審，評(píng)標(biāo)會(huì)當(dāng)天，評(píng)審委員會(huì)根據(jù)投標(biāo)人提交的方案文本、展板、模型（如有）、述標(biāo)答辯情況以及多媒體文件進(jìn)行評(píng)審。
評(píng)審委員會(huì)通過(guò)記名投票法（逐輪淘汰）進(jìn)行評(píng)審，選出無(wú)排序的前5名進(jìn)入定標(biāo)階段，后4名獲得方案補(bǔ)償費(fèi)。
9 design teams explain their plans to the Scheme Review Jury.
The Scheme Review Jury evaluate the design scheme according to the text, display board, model (if any), presentation and video submitted by the bidder.
The Scheme Review Jury adopts vote by open ballot to determine the top 5 candidates for winner without ranking, and the last 4 receive compensation fees.
4.3第三階段-定標(biāo)階段
Stage3-Deciding the Winning Bidder
定標(biāo)辦法：直接票決法
評(píng)審委員會(huì)研究評(píng)選出的不排序的前5名設(shè)計(jì)單位向定標(biāo)委員會(huì)進(jìn)行述標(biāo)答辯。（暫定）
根據(jù)定標(biāo)委員會(huì)的投票結(jié)果，中標(biāo)候選人將被授予對(duì)應(yīng)小鎮(zhèn)的方案設(shè)計(jì)合同。招標(biāo)人有權(quán)確定同一家設(shè)計(jì)單位至多可以中標(biāo)兩個(gè)小鎮(zhèn)的方案設(shè)計(jì)合同。未中標(biāo)的設(shè)計(jì)單位獲得方案補(bǔ)償費(fèi)。
若主辦單位認(rèn)為其中一個(gè)或多個(gè)小鎮(zhèn)的設(shè)計(jì)方案不具備可實(shí)施性，則有權(quán)不確定中標(biāo)候選人，給予方案補(bǔ)償費(fèi)。若主辦單位認(rèn)為所有設(shè)計(jì)單位的方案均不具備可實(shí)施性，則不授予各投標(biāo)人合同，給予方案補(bǔ)償費(fèi)。
Rules : Direct voting
The top 5 design teams (not ranked) selected by the Scheme Review Jury explain their plans to the Winner Deciding Jury. (provisional)
According to the voting results, the winning bidder will be awarded the design contract for the corresponding town. The tenderee has the right to determine that the same design team can win the contract of at most 2 towns. The unsuccessful design team will get the compensation fee.
If the tenderee thinks that the design scheme of one or more towns is not feasible, it has the right not to determine the winning bidder and give they the compensation fee. If the tenderee thinks that all the schemes of the design teams are not feasible, the contract will not be awarded and the compensation fee will be given.
五、合同暫定價(jià)及方案補(bǔ)償費(fèi)
Provisional Contract Price and Design Compensation
5.1投標(biāo)報(bào)價(jià)上限價(jià)
Price limit
本項(xiàng)目的方案設(shè)計(jì)單方價(jià)格上限為80元/m2。最終合同價(jià)格根據(jù)中標(biāo)單位的投標(biāo)報(bào)價(jià)函確定。
The upper limit of the design price is 80 yuan / m2. The final contract price shall be determined according to the Offer Letter of the winning bidder.
5.2方案補(bǔ)償費(fèi)支付方式
Payment of design compensation
中標(biāo)候選人將被授予方案設(shè)計(jì)合同，不再給予方案補(bǔ)償費(fèi)；進(jìn)入定標(biāo)環(huán)節(jié)的未中標(biāo)的投標(biāo)人，分別給予方案補(bǔ)償費(fèi)每家各40萬(wàn)元；入圍方案投標(biāo)階段但未進(jìn)入定標(biāo)環(huán)節(jié)的投標(biāo)人分別給予方案補(bǔ)償費(fèi)每家各30萬(wàn)元。
若方案均不具備可實(shí)施性，則不授予各投標(biāo)人合同，入圍定標(biāo)環(huán)節(jié)的投標(biāo)人分別給予方案補(bǔ)償費(fèi)每家各40萬(wàn)元；入圍方案投標(biāo)階段但未入圍定標(biāo)環(huán)節(jié)的投標(biāo)人分別給予方案補(bǔ)償費(fèi)每家各30萬(wàn)元。
投標(biāo)人參加本次投標(biāo)的所有費(fèi)用（含差旅住宿費(fèi)）均自行承擔(dān)。如評(píng)標(biāo)委員會(huì)認(rèn)為投標(biāo)人提交的成果文件未達(dá)到本次招標(biāo)工作深度及要求的，招標(biāo)人將不予支付其方案補(bǔ)償費(fèi)。
The winning bidder will be awarded the scheme design contract without any compensation fee; the unsuccessful bidders who enters the deciding stage will be given the design compensation of RMB 400000 for each company; and the bidders who enters the bidding stage but does not enter the deciding stage will be given the design compensation of RMB 300000 for each company.
If the schemes are not implementable, the contract will not be awarded to each bidder.The bidders who enters the deciding stage will be given a compensation of RMB 400000 for each company; and the bidders who enters the bidding stage but does not enter the deciding stage will be given the design compensation of RMB 300000 for each company.
All related expenses such as the travelling expense will be covered by the participants themselves. If the jury considers that the deliverables submitted can't meet the depth and requirements, the tenderee won't pay any compensation.
六、招標(biāo)日程
Bidding Schedule
以上所有時(shí)間均以北京時(shí)間為準(zhǔn)，招標(biāo)人保留調(diào)整日程安排的權(quán)利。
All time shall be subject to Beijing time, and the bidder reserves the right to adjust the schedule.
七、知識(shí)產(chǎn)權(quán)及相關(guān)法律
Intellectual Property and Related Laws
7.1由招標(biāo)人提供的資料、軟件和其他物品,其所有權(quán)(包括版權(quán))等合法權(quán)益歸招標(biāo)人。未經(jīng)招標(biāo)人書(shū)面同意，設(shè)計(jì)機(jī)構(gòu)不得擅自使用或交由任何第三方使用前述資料、軟件和其他物品，否則投標(biāo)人應(yīng)承擔(dān)由此產(chǎn)生的所有責(zé)任并賠償招標(biāo)人因此受的所有損失。
All documents provided by tenderee to participants (including texts, drawings, and electronic data) are exposed to copyright protection. Without written consent of the tenderee, any person is prohibited to duplicate, amend, distribute, disclose, lend or transfer the contents of relevant materials. Otherwise, one should bear related legal liabilities.
7.2所有參加本招標(biāo)活動(dòng)的設(shè)計(jì)所有權(quán)歸投標(biāo)人所有，但所有參與投標(biāo)的設(shè)計(jì)文件在評(píng)審后不退回投標(biāo)人。
The ownership of all design participating in this tender activity belongs to the tenderee, but all design documents participating in the bidding will not be returned to the bidder after review.
7.3招標(biāo)人可以無(wú)償展示所有設(shè)計(jì)文件，包括在評(píng)審結(jié)束后公布評(píng)審成果，并通過(guò)傳媒、專業(yè)雜志、專業(yè)書(shū)刊或其它形式介紹、展示及評(píng)價(jià)設(shè)計(jì)文件。
The tenderee are entitled to use the design schemes without further payment, such as introducing, displaying and appraising the design schemes through media, professional magazines, books or other form after announcing the evaluation result.
7.4投標(biāo)人就本項(xiàng)目在工程招標(biāo)或設(shè)計(jì)上使用的或準(zhǔn)備采用的任何專利、版權(quán)、設(shè)計(jì)商標(biāo)或名稱及其它受保護(hù)權(quán)利的都必須取得合法的授權(quán)，所產(chǎn)生的有關(guān)費(fèi)用應(yīng)由投標(biāo)人承擔(dān)。
如投標(biāo)人由于在工程招標(biāo)或設(shè)計(jì)上使用的或準(zhǔn)備采用的任何專利、版權(quán)、設(shè)計(jì)商標(biāo)或名稱及其它受保護(hù)權(quán)利的行為而引起的所有索賠和訴訟的費(fèi)用都應(yīng)由投標(biāo)人承擔(dān)。此外，投標(biāo)人還應(yīng)承擔(dān)由本條款直接導(dǎo)致招標(biāo)人相關(guān)的經(jīng)濟(jì)賠償、訴訟費(fèi)、財(cái)產(chǎn)保全費(fèi)、律師費(fèi)、公證費(fèi)及其它開(kāi)支、費(fèi)用。
上述應(yīng)由投標(biāo)人承擔(dān)的所有費(fèi)用由投標(biāo)人人自行承擔(dān)。
Any patent, copyright, design trademark or name and other protected rights used or to be adopted by the bidder in the project bidding or design must be legally authorized, and the relevant expenses incurred shall be borne by the bidder.
All claims and litigation costs caused by any patent, copyright, design trademark or name and other protected rights used or prepared to be adopted by the bidder in the project bidding or design shall be borne by the bidder. In addition, the bidder shall also bear the economic compensation, legal fees, property preservation fees, attorney fees, notary fees and other expenses directly caused by this clause.
All the above expenses to be borne by the bidder shall be borne by the bidder.
7.5投標(biāo)人承諾其所提供的本項(xiàng)目的設(shè)計(jì)成果僅供本項(xiàng)目使用。投標(biāo)人應(yīng)保護(hù)招標(biāo)人一旦使用其設(shè)計(jì)方案/設(shè)計(jì)成果不能受到來(lái)自第三方的侵權(quán)訴訟或索賠，否則投標(biāo)人應(yīng)承擔(dān)由此而產(chǎn)生的一切責(zé)任。
The bidder promises that the design results of this project provided by it will only be used for this project. The bidder shall protect the tenderee from infringement lawsuits or claims from a third party once the design scheme/design results are used, otherwise the bidder shall bear all the responsibilities arising therefrom.

8.1本項(xiàng)目投標(biāo)申請(qǐng)人需要下載的所有相關(guān)文件須前往深圳城市設(shè)計(jì)促進(jìn)中心網(wǎng)站下載。（http://www.szdesigncenter.org/）
All application documents needed by the bidder are available at 1) Shenzhen Center for Design Website.(http://www.szdesigncenter.org/)
8.2 招標(biāo)文件的解釋權(quán)屬于招標(biāo)單位。解釋語(yǔ)言以中文為準(zhǔn)。
The tenderee reserves the rights for the interpretation of this bidding documents. The Chinese interpretation shall prevail.
8.3 招標(biāo)工作的日程安排均以北京時(shí)間計(jì)算。
The schedule of bidding work is subject to Beijing Time.
8.4 本次活動(dòng)有關(guān)的所有往來(lái)通知、函件、成果文件均應(yīng)使用中文，投標(biāo)人的設(shè)計(jì)團(tuán)隊(duì)?wèi)?yīng)至少配備一名通曉中文的設(shè)計(jì)人員。
All notifications, correspondence, and deliverable related to this bid should be in Chinese, and the design team should be equipped with at least one designer who is proficient in Chinese.
8.5 招標(biāo)文件、補(bǔ)遺（答疑）文件、各類通知函件均以書(shū)面文件為準(zhǔn)。當(dāng)招標(biāo)文件、補(bǔ)遺（答疑）文件、各類通知函件內(nèi)容相互矛盾時(shí)，以最后發(fā)出的為準(zhǔn)。
The bidding documents, addendum (Q & A) documents and all kinds of notice letters shall be subject to the written documents. If there is any contradictory between these files, the final issue shall prevail.
8.6 投標(biāo)人應(yīng)確保其項(xiàng)目負(fù)責(zé)人和主要設(shè)計(jì)人員始終參與本設(shè)計(jì)工作; 境外設(shè)計(jì)單位應(yīng)確保有境外單位的人員參與、簽名和加蓋境外單位印章。
The bidders should guarantee the participation of the project leader and major designers in the whole design. As for overseas companies, they shall ensure the foreign architects' participation, their signatures and company's stamp.
8.7 參加本次招標(biāo)活動(dòng)的投標(biāo)人均視為承認(rèn)本招標(biāo)文件所有內(nèi)容。
All the bidders will be regarded to confirm all the contents of this binding documents.
8.8在招標(biāo)期間，招標(biāo)人可根據(jù)需要，隨時(shí)終止本次招標(biāo)工作，招標(biāo)人不負(fù)擔(dān)因此給投標(biāo)人造成的損失。
During the bidding period, the tenderee may terminate this bidding at any time according to the needs, and the tenderee shall not bear the losses caused to the bidders.
8.9 《投標(biāo)確認(rèn)函》遞交時(shí)間為2020年12月31日。如因疫情等原因在2020年12月31日無(wú)法提交鮮章原件的投標(biāo)人，可以先提交掃描打印文件，并且在2021年1月13日17：00之前遞交《投標(biāo)確認(rèn)函》的鮮章原件，掃描打印文件與鮮章原件缺一不可。
The Bid Confirmation Letter is submitted on December 31, 2020. If the original fresh seal cannot be submitted this time due to epidemic or other reasons, the scanned document can be submitted first, and the original fresh seal of the Bid Confirmation Letter must be submitted before 17:00 on January 13, 2021.

Consortium Agreement (if any), joint design group should submit the Joint Design Agreement jointly signed by all the members, and specify the leading party (It must be stamped with the official seal of all members of the consortium and fresh seal is required. If affected by factors such as the epidemic, the consortium agreement should be submitted by 17:00 on December 31 at the latest).
